1. Acceptance of Terms
By accessing this website (www.pixelparkmedia.com) or engaging Pixelpark Media ("Agency", "We", "Us") for services, you ("Client", "You") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services
Pixelpark Media provides digital services including but not limited to:

  • Web Design & Development (Shopify, WordPress, Framer)

  • AI Automation & Chatbot Integration

  • Branding & Strategy Consulting

We reserve the right to refuse service to anyone for any reason at any time.

3. Payments & Fees

  • Payment Schedule: A 50% non-refundable deposit is required before any work begins. The remaining 50% balance is due upon project completion, before the final website launch or transfer of ownership.

  • Late Payments: Invoices not paid within 7 days of the due date may result in a pause of services. If payment is delayed beyond 30 days, a 5% late fee will be applied to the outstanding balance.

  • Taxes: All fees are exclusive of applicable taxes (GST), which will be charged separately where applicable.

4. Client Obligations
To ensure the timely completion of the project, the Client agrees to:

  • Provide all necessary content (text, images, logos, credentials) within the agreed timeline.

  • Provide timely feedback (within 3 business days) on design drafts.

  • Delays caused by the Client’s failure to provide assets or feedback will result in a revised project timeline.

5. Intellectual Property Rights

  • Agency Ownership: Pixelpark Media retains full ownership of all design concepts, code, and drafts until full payment is received.

  • Client Ownership: Upon full payment of the final invoice, the Client is granted exclusive ownership of the final website and its content.

  • Portfolio Rights: We reserve the right to display the completed work in our portfolio, website, and social media for promotional purposes.

6. Third-Party Tools & AI Services
We may integrate third-party tools (e.g., Shopify, OpenAI, Zapier) into your project.

  • We are not responsible for any changes, downtime, or data breaches caused by these third-party platforms.

  • Any subscription fees for these tools (e.g., Shopify monthly plan, OpenAI API costs) are the sole responsibility of the Client.

7. Limitation of Liability
In no event shall Pixelpark Media be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities, arising out of the use of our services. Our total liability shall not exceed the total amount paid by the Client for the specific project.

8. Revisions & Scope
Our project packages typically include 3 rounds of revisions. Any additional work or changes outside the initial scope will be billed at our standard hourly rate.

9. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of West Bengal, India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Kolkata.
